Value Added Tax (VAT) refund service is applicable to all foreigners using valid passports, not issued by competent Vietnamese State agencies. If you enter and exit Vietnam and are not a member of the flight crews on flights from Vietnam to abroad, you will be entitled to a tax refund at Vietnam airport.

How to get a tax refund at Vietnam airport?

In order to receive a tax refund, passengers must buy goods at business establishments conducting a pilot sale of VAT refund goods in Vietnam and bring such goods with them when leaving the country.

Tax refund at Vietnam airport frequently asked questions

What types of goods are eligible for tax refund?

– Belonging to the group subject to VAT, have not been used and are allowed to be brought on board in accordance with the law on aviation safety;

– Goods not on the List of goods banned from export or the List of goods restricted from export;

– There are invoices cum tax refund declarations issued within 60 days before exit procedures;

– The value of goods stated on the invoice cum tax refund declaration purchased at 1 store in 1 day (including adding multiple purchase invoices in the same day at 1 store) is at least 2 million VND or more.

What documents do you need to get a tax refund at Vietnam airport?

1. In case VAT refunded goods are placed in checked baggage:

Passengers present goods and related documents as follows for customs inspection:

– Goods with VAT refund;

– Passport (original);

– Invoice cum tax refund declaration certified by a qualified business establishment and stamped with the customs authority’s “Agreement for tax refund” stamp (original).

Note: Passengers who need a tax refund must check-in early to promptly complete the procedures at the tax refund counter (near departure gate 8-9).

2. In case VAT refunded goods are placed in hand luggage:

After completing the check-in procedure, passengers bring the following goods and documents to the counter to the tax refund counter for customs inspection and tax refund procedures:

– Goods with VAT refund;

– Passport (original);

– Boarding pass;

– Invoice cum tax refund declaration certified by a qualified business establishment and stamped with the customs authority’s “Agreement for tax refund” stamp (original).

How much will I get and when will I receive the VAT refund?

Passengers will receive an amount of refund as 85% of the total amount of VAT amount noted in the invoice, as well as stated in the VAT refund declaration form.

The other amount of 15% is charged as a refunding fee for the bank. In genereal, you uiwll be able to receive the refund immediately right after you finish the VAT refund procedure.

Where can I purchase goods that are applicable for a VAT refund at Vietnam airports?

How to get a Vietnam Visa at Danang Airport? 

Please follow the signboards with the name “Visa On Arrival” Counter. Here, you present: 

  • Your original Passport, the Visa Approval Letter, and the NA1 form with photos are attached. Then, take a seat to wait for the Vietnamese Officer.
  • After checking, they will call you to pay the stamping fee.
  • Take a look at your visa application and come to the cashier counter to make a payment, and you will be allowed to enter Vietnam.

NOTE: at Danang Airport, only cash is accepted, and USD is recommended.

A work permit is an extremely important document for foreigners to legally work in Vietnam. In this article, VTJ will detail all information related to the re-issuance of work permits for foreign workers.

These issues are all specified in Decree 152/2020/ND-CP of the Government regulating foreign workers working in Vietnam and recruiting and managing Vietnamese employees working for Vietnam. foreign organizations and individuals in Vietnam.

1. Cases of re-issuance of work permits
Re-issuance of work permits for foreigners: how to do?

According to the provisions of Article 12, Decree 152/2020/ND-CP, people who can ask for the re-grant of work permits:

  • Foreign workers whose valid work permits are lost,
  • The foreign worker has a damaged work permit, or
  • Foreign workers change their last name and name, nationality, passport number, working location stated in the valid work permit.

Note: Previously, the work permit used to be valid for at least 5 days but not more than 45 days. But according to the provisions of Decree 152/2020/ND-CP, effective from February 15, 2021, this case is subject to work permit extension.

2. Dossiers for re-issuance of work permits

To apply for a work permit reissuance, the employer and the foreign worker will have to prepare the following documents:

  • Sample of the employer’s written request for re-issuance of a work permit according to the provisions of Form No. 11/PLI (original) (Download).
  • 02 color photos 4cm x 6cm, white background, taken within 06 months from the date of application submission.
  • Written approval of the need to employ foreign workers, except for cases where the need to employ foreign workers is not required (original or notarized copy).

Documents proving the reason for applying for re-issuance of the work permit, which are:

  • If applying for re-issuance of a lost work permit: Confirmation of the commune-level police office where the foreigner resides (original/ notarized copy). Or, Certification by a competent foreign authority in accordance with the law. This needs consular legalization and notarized translation into Vietnamese, unless under exemption.
  • Papers proving the change in the contents of the work permit (original or notarized copy if it is a Vietnamese document, a consular legalization copy and notarized translation into Vietnamese if it is a Vietnamese document issued by a foreign country unless exempt from consular legalization).

3. The fee for re-issuance of work permits

According to the provisions of Point b, Clause 2, Article 3 of Circular 02/2014/TT-BTC, the fee for re-grant of a work permit must not exceed VND 450,000/permit. This fee may vary from province to province.

4. Procedures for re-issuance of work permits

Procedures for re-issuance of work permits for foreigners include 4 specific steps as follows:

Step 1: Notify the employer

After discovering the loss of a work permit, a damaged work permit, or a change in information about full name, date of birth, nationality, passport number, passport issue date, working location compared to the original document.

If the work permit is in use, the employee must report to the employer as well as perform other necessary work, for example, obtain the certification of the competent authority in case of loss of the work permit. .

Step 2: Prepare the application for the re-issuance of work permits

In this step, the employer and the employee will prepare a full set of 4 documents mentioned in the above profile section.

Step 3: Submit application for re-issuance of work permits for foreigners

The application for re-issuance of a work permit will be submitted to the Ministry of Labor, Invalids and Social Affairs or the provincial Department of Labor, War Invalids and Social Affairs where people issue the lost, damaged, or altered work permit information.

Step 4: Get the result

The employer will receive a re-issued work permit or a written refusal to re-issue it with reasons within 03 working days from the date of receipt of a complete dossier of application for a work permit reissuance.

Above is the entire procedure for re-granting a work permit for foreign workers in Vietnam.

5. Re-issued work permit duration

The term of the re-issued work permit is equal to the term of re-issuance of work permits. This minuses the time the foreign worker has worked up to the time of applying for the re-issuance of the work permit. This is clearly stated in Article 15 of Decree 152/2020/ND-CP.

COVID has affected all of our lives and now that it has, at last, started to abate, international travel is again at last possible. Vietnam was one of the last places to accept visitors (and even allow people to leave and return once again) and now it has reopened it can be difficult to work out the rules and regulations to enter. Below is some information on the Covid regulations and procedures to get into Vietnam:

We will take you step by step through the process – enabling you to be confident that you have ticked all of the boxes and your transition into the wonderful world of Vietnam will be as smooth as possible.

Covid regulations and procedures to get into Vietnam

At the time of writing (mid-April 2022), the Covid regulations and procedures to enter Vietnam are as follows:

Passengers must have:

  • A negative COVID- 19 NAAT, RT-LAMP or RT-PRC test taken at most 72hours before departure or,
  • A negative COVID- 19 rapid antigen test taken at most 24 hours before departure.

This does not apply to passengers younger than 2 years

This is very good as it means you have a choice- the PRC test ( the first option ) is a much more expensive and detailed type of test however the advantage of this is that you can take it 72 hours before departure. Note that they will use the stated departure time of the aeroplane – not the actual time – so don’t worry if the plane is delayed and sets off an hour or so later than anticipated! The advantage of taking it early means that if by any chance you do test positive for COVID then you will have more time to be able to sort out and change your flight – with the 24-hour option you would really be racing around.

The Covid regulations and procedures regarding the exact method of test-taking is rather lax. Some countries demand that the test is taken at a specified clinic – or at the very least that it is a service that has a video that watches you take the test to ensure that you are doing it yourself and correctly. However, Vietnam does not worry about that – all you are trying to achieve is a certificate that states the date and time of the test and the test result. Please note that the certificate does need to come from a government-approved organization (so you cannot just make your own!)

After you have your certificate that proves, you are negative for COVID you need to upload it to the official government site – https://tokhaiyte.vn/?page=login

Covid regulations and procedures- Health declaration

You need to register for an account and then fill in an online form that asks for your official details, the details of the flight, the place that you will be staying whilst in Vietnam ( in case they need to contact you ) as well as your COVID details.

Please note that the form cannot simply be opened and stays open for a long period of time ( e.g. a day or more ) so it is best to look at the form and know what is needed – get the information and then complete it all at once.

When you get to the website page there is a choice of three types of forms:

  • Domestic move declaration ( this is if you move from one place within Vietnam to another )
  • For people entering – entry declaration – THIS IS THE FORM YOU NEED TO ENTER THE COUNTRY
  • Public declaration ( for domestic guests )

The form is available in a variety of languages (simply press the corresponding flag). It is important to note that this form is taken very seriously – it is an official document so do not be tempted to make things up!

After you have filled in basic information details, there is a section on symptoms and where you have been. Note that if you tick “yes “(well – in the form it is actually “have “ ) to any of these then you will probably not be allowed into the country.

Although it now does not matter if you are vaccinated or not (even those with no COVID vaccinations can now enter) there is a section on the form which asks for details about your vaccination and asks for the upload of a certificate. You simply press the blue button ( which doesn’t translate ) to add another vaccination – so if you have been vaccinated against COVID twice then you press the blue button twice and you will add two sets of information ( endearingly mistyped as “ nose “ instead of “ dose “ ! )

Note that for the British there is only one option – English – rather than British or United Kingdom – or even Scottish and Welsh added to the English. This is just a misunderstanding – so if you live in the UK you need to put yourself down as “English “on this form.

The vital part of this form is the last section – the testing. You simply add the information and then upload the certificate. It will show how much of the file has been uploaded and will then tell you the file has been uploaded – note that this only comes up momentarily – so you do need to watch to check

Once completed, you simply add in the security code and press send.

Covid regulations and procedures- the QR code

You will then have a page with a QR code on it – this is the VITAL box for entry into the country. There is intermittent internet within the airport and no internet at all at the place where you need to show the QR code so it is vital that you either print out the QR code or take a photo so that you can show it.

When you arrive in the country before immigration (where you show your passport etc.), there is a table with people sitting and some small box machines. The people sitting there will be holding up and showing the page with the QR code that was generated after you sent off the form so you will know it is the time to show your QR code. You simply press your QR code against the box machine and that is it – it is a simple two-second procedure! After this, you simply carry on to immigration, as usual, to deal with visas etc.

Overall, the Covid regulations and procedures are quite straightforward when it is all broken down into easy steps – the important thing is to make sure that you have your test taken in the time frame dictated, that you fill in the form before you get to the country and that you have your QR code all ready to show – welcome to Vietnam!

This article will tell you what an Apostille is, and help you understand the similarities and differences between Apostille and Consular Legalization, and whether you can get an Apostille in our country.

1. What is an Apostille?

“Apostille” is a term that originated from France, which means certification. If a document is stamped with the Apostille certification stamp, it proves that the document is genuine, not a forgery.

An Apostille certificate verifies the signature and seal on a public document so that it can be used in one of the countries that have signed the Hague Convention (convention on exemption from legalization of foreign public documents). ). The authority to issue the Apostille Certificate is usually the Ministry of Foreign Affairs of the country issuing the document to be used.

List of States Parties to the Hague Convention

Currently, there are 120 countries that have signed the Hague Convention to exempt consular legalization for documents of countries below:

As such, the Apostille certificate is only valid for use in member countries under the Hague Convention. Meanwhile, according to the above table, Vietnam is not a member of the Hague Convention (Hague), so in order to use Apostille documents, applicants will continue to have to take one more step at the Embassy/General consulate of Vietnam in foreign countries. This step is called Consular Legalization.

Papers, documents certified Apostille:

Not all documents of the Contracting States of the Hague Convention can be Apostille certified.

Basically, documents that are eligible for Apostille certification are divided into 2 categories as follows:

Public documents signed by a government official, for example:

  • Registration of marriage
  • Birth certificate
  • Death Certificate
  • Business registration certificate
  • Court order
  • The document has been signed by a notary or a Commissioner for Oaths

However, the following documents are not Apostille certified

  • Documents prepared by a consular or diplomatic officer
  • Administrative papers that are directly related to customs or commercial activities.
  • Benefits of Apostille Certification

Obviously, without doing consular legalization of documents that qualify for Apostille certification in aforementioned countries, the document holder was able to shorten the process by half. Thanks to that, it saves time, costs as well as effort to learn and implement the procedure.

2. What is consular legalization?

What is the difference between Apostille and Consular Legalization?

As mentioned above, there are 2 processes that need to be followed to be able to use papers and documents in a country other than the issuing country, which is Apostille and Consular Legalization. Which process you need to go through will depend on the document type, issuing country, and country of use;

Apostilles:

For documents that are eligible for Apostille certification, if you intend to use the document in a member state of the Hague convention, simply apply for the Apostille stamp.
For example, if you have a birth certificate issued in the UK and want to use it in Korea, you can simply apply for an Apostille at the Department of Foreign Affairs and Commonwealth Affairs, and be able to use that document in Korea.

Consular legalization

If you have documents that are eligible for Apostille certification, but intend to use them in a country that is not a member of the Hague Convention, you will need to obtain an Apostille stamp from a competent authority of the issuing country, then apply for a consular legalization stamp from the embassy/consulate of the country that will use the document located in the issuing country.

For example, if you want to use a British birth certificate in Vietnam, you will need to obtain an Apostille at the Department of Foreign Affairs and Commonwealth Affairs, then apply for a consular legalization stamp from the Ambassador Consulate/Consulate General of Vietnam in the UK.

For documents that do not qualify for Apostille certification, or the issuing country is not part of the Hague Convention, you will need to apply for a consular stamp at the competent diplomatic mission of the issuing country, then apply the consular legalization stamp of the Embassy/Consulate of the country that will use the document is located in the issuing country. For example, Thai documents that want to be used in Vietnam will need consular certification at the Ministry of Foreign Affairs of Thailand first, and then consular legalization at the Vietnamese Embassy/Thailand.

Thus, when you use documents in a country belonging to The Hague, the Apostille certified documents will not have to go through the consular legalization step at the Embassy of the country where they are used.

Since Vietnam is not a member of the Hague Convention, except for papers exempted from consular legalization/certification, all foreign documents that want to be used in Vietnam and vice versa must go through consular legalization. However, this is not an easy procedure, especially for those who are doing consular legalization for the first time.

Vietnam entry procedures for foreigners from March 15, 2022

Foreigners are able to enter much more freely and comfortably. However, the following conditions must still be met:

  • Having an entry official approved by the Immigration Department (except for cases exempted from applying for an entry official).
  • Passport is still valid.
  • Make a temporary residence declaration before entry.

Vietnam entry procedures for foreigners from March 15, 2022

Cases that do not require applying for an entry letter

  • Entry by visa exemption
  • Have a valid permanent residence card.

Vietnam entry procedures for foreigners

For foreigners entering to get visa at the Airport, it is necessary to prepare the following documents:

  4. Expenses in cash for visa issuance at the airport (25 USD/single entry; 50 USD/multiple entry visa)
  5. The NA1 form. (You can declare it in advance or you can declare it at the border gate.)
  6. Photo 3×4

* Note:

  • If the foreigner has obtained a visa at the Embassy/Consulate, when arriving at the border gate, only need to present the passport, visa and their negative-for- Covid-19 test result.
  • Procedures for obtaining a visa at the Embassy/Consulate also include the above documents.

Vietnam entry procedures for foreigners entering Vietnam with visa exemption or without visa exemption:

You will only need your passport. 

For foreigners entering with an electronic visa (e-visa), prepare:

  1. Passport
  2. E-visa that has been issued.
  3. PCR test results

Foreigners need to carry out medical declaration and health declaration procedures according to instructions. In addition, you do not need to pay the visa issuance fee at the border gate anymore.

Countries that enjoy Vietnam visa exemption

From January 2022, people who come from these 25 countries DO NOT need a visa for Vietnam. Here is the list of these countries:

– Clean the test surface (such as table top, tray) with disinfectant solution. For example, a solution containing at least 70% alcohol.
– Prepare test equipment. The test kit includes the test tray (where the results are performed and displayed); buffer solution tube; funnel with filter; Sampling swab.
– The sampler must wear a mask, use gloves and a drop shield (if any).

STEP 2: SAMPLE COLLECTION

– The person taking the sample must wash his hands with an antiseptic solution before taking the sample.
– The person being sampled needs to sit still in a chair. When doing this, the sampler stands to the left or right of the person being sampled. Do not stand opposite to avoid droplets when sneezing.
– The sampled person pulls the mask over the nose but still covers the mouth. Tilt your head back about 70 degrees and relax.
– The sampler now gently inserts a cotton swab into one side of the nasal cavity, close to the floor of the nose to the posterior wall of the oropharynx.
– Rotate the sample strip 3-4 times to absorb enough fluid and then gently pull the strip out.

STEP 3: SAMPLE PROCESSING

– Insert the swab tip of the sample probe into the buffer solution tube, so that the swab tip is submerged in the solution. Dip the tip of the cotton swab several times in the buffer solution.
– When taking out the stick, should gently squeeze the tube wall to squeeze out all the water in the tip of the cotton swab. Then place the funnel containing the filter on the buffer tube.

STEP 4: READ THE RESULTS

– Add three drops of buffer (or according to the amount indicated in the kit’s instructions for use) from the buffer tube in the specimen cell on the sampling tray.
– The person taking the sample washes his hands with an antiseptic solution. Results read in 15-30 minutes.
– If the test tray shows only one bar in the position marked with the letter C, the rapid test is negative for Covid-19.
– If the tray shows two lines at position C and T, the rapid test is positive for Covid-19.
– If only one line appears at position T, or no line appears, the rapid test is unsatisfactory and the results are invalid.

STEP 5: AFTER SAMPLE PROCESSING

– After reading the results, put all used items in the bag and seal it. Avoid throwing these test kits directly into the household trash.
– The surface of the used test kit bag and the newly used table top must be disinfected with an antiseptic solution. Wash your hands with soap or sanitizer again after completing the test.
– Waste containing samples can be stored together with bags containing masks and tissues containing secretions after you test for Covid-19. Seal the mouth of the garbage bag, disinfect the outside of the bag with 70 degrees of alcohol or Chloramin B and place it in a trash can with a tight-fitting lid.

Visa is one of the required documents for many foreigners to enter Vietnam. When the visa is about to expire, you can apply for an extension. If You Overstay Your Visa in Vietnam, what will happen?

If you overstay your visa, there will be penalties for you, which depends on your visa overstay time. After paying an administrative fine with a penalty fee equivalent to the number of expiration dates, you can continue to have your visa extended in mild cases.

In more serious cases, you may be blacklisted, forced to be deported, or banned from re-entering temporarily or permanently.

As for the visa overstay fee, foreigners whose temporary residence card or permanent residence card in Vietnam is overstayed for less than 15 days without the consent of competent authority, will be fined from 500.000 to 2.000.000 VND.

If you overstay your visa for just 1 or 2 days, you do not need to contact the local Immigration Office; you can proceed to the airport and pay the penalty there (about $23/day) before obtaining an exit visa to depart the country.

Meanwhile, you can be fined an amount of money between 3.000.000 – 5.000.000 VND if you overstay them for more than 16 days.

Moreover, people who use fake documents related to passports, visas, temporary residence cards, and verification stamps will face a fine ranging from VND 5.000.000 to VND 10.000.000.

What To Do If You Overstay Your Visa?

When you overstay your visa in Vietnam, you only have two options below:

  • Continue to extend your visa: If the reason behind your overstayed visa is accepted, you can choose this method to continue residing in Vietnam. However, before being eligible for doing it, you must pay a fine.

The penalty cost will depend on the number of overstaying dates, as we mentioned above. You had better pay the fine on your own by going to the Immigration Department or the province where you are living.

  • Exit Vietnam: Most people probably don’t want this to happen; however, if your extending visa application is not accepted, you must exit Vietnam. And when you want to return to Vietnam, you have to apply for a re-entry visa

Nonetheless, in some cases, if you commit serious violations in the field of entry and exit or are on the “black list”, you will be banned from entering Vietnam for 5 years. When the ban period expires, you are allowed to re-enter Vietnam in accordance with the law.

How to Extend Your Overstayed Visa in Vietnam?

Visa extension conditions

  • Your passport must be valid as prescribed, which means that its validity must be longer than that of your visa by at least 1 month.
  • You’ve declared temporary residence according to regulations. You can declare directly at the commune or police station in your area where you live or do it online at the National Web Portal on Immigration.
  • You’ve paid administrative fines according to regulations as aforementioned.
  • Visa extension documents
  • Your original passport and visa in use
  • A copy of the temporary residence declaration.

Other documents depending on your kind of visa: Work permit/ Investment certificate/ Relative relationship certificate. Notably, they must be certified as true copies.
