(1) Foreigners who are members of diplomatic missions, consular offices, representative offices of international organizations of the United Nations, intergovernmental organizations in Vietnam, and their spouses and children under 18 age, the maid goes along with the term (symbol NG3).

The law does not prohibit foreign workers in Vietnam from signing labor contracts with labor outsourcing enterprises. However, in order to work for another enterprise, the foreign worker must obtain a new work permit in accordance with the provisions of the law.

21. What tax obligations do foreign workers have to fulfill before returning home?

24. Which cases do not have to apply for a work permit when hiring foreign workers?

The following cases are not required to apply for a work permit:

– Head of the representative office, project or main responsibility for activities of international organizations, foreign non-governmental organizations in Vietnam;

– Foreign lawyers who have been granted a license to practice law in Vietnam in accordance with the Law on Lawyers;

– Foreigners marrying Vietnamese and living in Vietnamese territory; and

– Other cases as prescribed by law.

  • Being 18 years or older and having full civil act capacity;
  • Having professional qualifications, techniques, skills and working experience;

Foreign workers are not allowed to enter into labor contracts with indefinite terms because the term of labor contracts for foreign workers in Vietnam must not exceed the term of the work permit. The term of the work permit is 2 years.

Vietnamese law can be applied to labor relations in case a foreign employee works in Vietnam but signs a labor contract with an employer abroad if:

(1) The International Labor Agreement to which Vietnam is a contracting party contains provisions on the application of Vietnamese law; or

(2) If an international treaty does not contain provisions different from the laws of Vietnam, then the laws of Vietnam shall apply; or

(3) International treaties allow parties to choose applicable law and parties to choose Vietnamese law.

4. When unilaterally terminating the labor contract in accordance with the law, what kind of allowances and benefits does the foreign worker enjoy?

In case the foreign worker unilaterally terminates the contract in accordance with the law, he will be entitled to the following allowances and benefits:

– Severance allowance (if any);

– Salary includes the actual unpaid working day salary, the salary for the annual leave days that the employee has not taken leave and other allowances; and

– The obligation to pay compulsory social insurance, health insurance (“HI”), and unemployment insurance (“UI”) into these insurance funds is performed by the employer; or

– An amount equivalent to the employer’s payment of social insurance, health insurance, and unemployment insurance premium in case the employer has not yet paid this amount in addition to the same salary payment period for the employee during the working period.

5. When the employer unilaterally terminates the labor contract in accordance with the law, what kind of allowances and benefits does the foreign employee enjoy?

6. When a foreign worker unilaterally terminates a labor contract illegally, what obligations must he bear? In this case, do they get any benefits or not?

The foreign worker illegally terminates the labor contract unilaterally if he fails to notify the employer in advance. Such foreign workers in Vietnam will have to bear the following obligations:

– Not entitled to severance pay;

– Compensation to the employer for half a month’s salary according to the labor contract;

– Compensation for an amount corresponding to the salary according to the labor contract in the days without notice; and

– Must reimburse the employer for training costs (if any).

However, in this case, the foreign worker still has the right to claim other benefits that belong to his or her basic interests, such as:

– Salary includes the unpaid actual working day salary, the salary for the annual leave that the foreign employee has not taken leave and other allowances; and

– An amount equivalent to the employer’s payment of compulsory social insurance, health insurance and unemployment insurance in case the employer has not yet paid this amount to the foreign employee during the working period.

7. When the employer illegally terminates the labor contract unilaterally, what kind of allowances and benefits are the foreign workers in Vietnam entitled to?

The employer illegally terminates the labor contract unilaterally if (i) there are no grounds for the unilateral termination of the labor contract and/or (ii) the notice period is violated. At that time, foreign workers in Vietnam will enjoy the following allowances and benefits:

In case the employer agrees to accept the foreign worker back to work, the foreign worker will receive the following benefits:

– Wages for the days the foreign worker is not allowed to work;

– To pay social insurance and health insurance premiums for the days the foreign employee is not allowed to work;

– Pay an additional amount equal to at least 02 months’ salary according to the labor contract;

– An amount equivalent to the salary according to the labor contract for unannounced days in case of breach of notice obligation.

In case the foreign worker does not want to continue working, in addition to the amounts specified in item a, the foreign worker is also entitled to an additional severance allowance.

In case the employer does not want to take back the foreign worker and the foreign worker agrees, in addition to the amounts in items a and b above, the foreign worker is also entitled to an additional compensation equal to at least two months’ salary under the labor contract.

– The Labor Code allows employees to enter into many labor contracts with many employers but must ensure the full implementation of the signed contents. For foreign workers, they must have a work permit corresponding to each employer they work for.

9. Foreign workers who have paid insurance in foreign countries according to the regulations of that country, can they deduct this part of insurance when finalizing tax in Vietnam?

– Foreign employees working in Vietnam will be deducted the insurance premiums paid abroad when finalizing personal income tax (“PIT”) on salaries and wages if the following conditions are met:

– The compulsory insurance paid must be similar to the provisions of Vietnamese law such as social insurance, health insurance, unemployment insurance, compulsory professional liability insurance, and other compulsory insurances (if any); and

– Must have proof of participation in paying the above insurance.

10. Foreign workers in Vietnam who voluntarily contribute to the retirement pension fund of the social insurance agency for a period of 20 years will be entitled to a pension when they reach the prescribed retirement age.

In fact, in case a foreigner voluntarily contributes to the retirement pension fund, the social insurance agency will refuse to collect this amount because the foreign worker is not eligible to participate in voluntary social insurance.

Moreover, before January 1, 2022, foreign workers are also not eligible to contribute to the retirement and survivorship fund, but from January 1, 2022, onwards, foreign workers in Vietnam are the subjects to contribute to the retirement and survivorship fund. If the foreign employee fully contributes to the retirement pension fund for at least 20 years from January 1, 2022, he/she will be entitled to a pension in accordance with the law.

11. When terminating the labor contract with the employer, does the term of the work permit automatically terminate?

One of the cases causing the work permit to expire is the termination of the labor contract. Therefore, when the labor contract is terminated, the labor license is automatically terminated.

12. If the foreign worker is the head of a representative office in Vietnam and receives a salary from a foreign company, who will be responsible for declaring and finalizing tax for this person?

Are not. Vietnamese law does not have specific provisions on limiting the rights of foreign workers when working in Vietnam. However, in order to work in Vietnam, foreign workers must meet the conditions under Vietnamese law to be able to carry out the procedures for applying for a work permit if they are not eligible for a work permit.

At the same time, foreign workers in Vietnam are only allowed to work in positions such as manager, executive, expert, and technical worker Vietnamese workers cannot meet according to production and business needs.

Walking down the street in Vietnam is not the same as walking down the street in the West and is full of sights, sounds and smells that may well surprise you. Some of these are great – others not so much – however all are pretty fascinating! 

The street itself 

When you walk down the street in Vietnam, the first thing you will notice is the fact that although many roads have pavements, these are not dedicated to pedestrians and instead are crowded with motorbikes, small stools, and mini tables for cafes, sellers of various goods and even some rounded cages for animals such as chickens and roosters. This means that you have to have your wits about you as you need to be vigilant of all these things that you need to avoid rather than simply walking in a straight line along the pavement as you may well expect.

In addition to the crowded pavement, it is important to note that unlike the West in which pavements are required to be constantly maintained so that they are smooth and easy to walk on, in Vietnam the pavement may well have holes (some of which are quite large) and sections which have come away, etc. This means that you do need to look at where you are stepping instead of confidently striding ahead. On the positive side, however, these very uneven pavements are very good for your hips as the uneven surface makes your hips work more than they would on a flat surface – there is always a positive side to everything!!

The rubbish 

As you walk down the street in Vietnam, although there are rubbish trucks, the majority of the cleaning of the street in the middle of the towns is done by people in the shops directly behind the pavement. It is a common sight to see the shop keeper starting their day by sweeping the area in front so that is nice and clean – and this means that on the pavement itself, there is little rubbish spread around. However, in the area between the edge of the road and the pavement, there are often small rubbish piles where people have swept it all and it will be collected later on. It doesn’t interfere with your walking that much – simply step over or around it.

The motorbikes 

Motorbikes are the biggest problem on the pavement for two main reasons when you walk down the street in Vietnam. The first is that motorbikes often travel on the pavements – this may be because there is a traffic jam on the road so bikers are making a detour on the pavement or alternatively if the street is a one-way street then bikers will travel on the pavement the wrong way.

Although there are parking areas, typically most shops will not have a parking area nearby and since most of their customers will travel to the shop by motorbike, then when they wish to visit the shop they will simply park outside the shop on the pavement. This often means that the pavement is totally full of motorbikes and there is no space to pass by when walking. If this is the case, then you need to make a detour into the road ( being vigilant for motorbikes as you need to have the awareness that motorbikes may be coming in both directions ).

Pop up cafes 

You will find that when you walk down the street in Vietnam, it is a place where people eat – although some cafes have proper awnings etc and the street section is part of the main café, the majority of them are simply pop-up cafes. The most popular will be a kind of cart which has all of the cooking materials on it and serves as the kitchen area. One section of the cart will have carried the mini stools and these are then spread out on the pavement to become the seating area. This means that the whole pavement will be taken up with stools and people eating, thus you have a choice to either walk in between the people and thus potentially disturb their eating or skirt around them – walking in the road.

The sellers 

You will find that in the centre of towns/cities (particularly in the tourist areas ) there are a lot of sellers – these can be people who have a cloth laid out on a cart or on the floor and have spread goods out on them or have a cart with items to sell on. In addition, there will be many ladies with the traditional double baskets balanced on a pole which is carried along on a shoulder. These ladies typically sell fruit or snacks and can be quite persistent. One common ploy is to seem to give you something – it is a natural reaction to accept something which someone is giving you – however, once you have accepted it then you need to purchase it!

When you walk down the street in Vietnam, it is important to remember that the people who are selling on the street are not there for fun – this is their livelihood and they have hard lives. As a result, although it is easy to be irritated with people badgering you to buy things, it is better to simply decline if you don’t want anything or purchase with a smile if you do!

The selfies

As you walk down the street in Vietnam you will find people taking photographs everywhere you look. Photographs are immensely popular in Vietnam and you will find that there are lots of photo opportunity places set up in tourist areas and shops so that people can have an amazing background for their selfies. 

As a foreigner, you will find that many people are keen to have their photograph taken with you ( with this being even more popular the more you leave the cities) It is up to you whether you want to have your photo taken or not – it is fine to politely say no if you don’t want to and very easy to just smile at the camera if you chose to do so! 

When walking down the street you will sometimes invariably need to step in front of the photo-taking to carry on your path – although you can try and wait until the photo has been taken you will find that the photographs are not simply a point and press as in the West but much more of an elaborate set up with various poses and things to hold etc – so it is not easy to wait. Instead, use your judgement of politeness – pause a little before you march straight in front and try to let people see that you are going to walk ahead so that they can hold off for a second or two. 

 Overall, the street in Vietnam is an amazing place – full of energy and life. It is not easy to simply walk down the street in a straight line with all that is going on in the lively street but as long as you are not trying to march from A to B at high speed then you will find it a place of fun and excitement – so accept it for what it is – and take time to meander instead of walk.

If you work with children at schools in Vietnam, there will inevitably be a time when you need to go on a school trip with the children. These are very different to trips that you may have previously taken with children in other countries so best to be prepared. Let’s find out what you need to prepare when going on a school trip in vietnam with VTJ now!

As with all trips, it is important to initially prepare. You will find that your school will have a risk assessment form to fill in.  This is usually quite a long and detailed document which outlines the possible hazards that may be produced through the trip and ways that you can counteract these as much as possible. 

However, you may be surprised to find that typically teachers simply copy a previous risk assessment form rather than actually going to the site to check to see if anything has changed between the previous visit and this one. You then have a choice of simply agreeing that there is not much chance of some major changes at the location between the previous visit and now, or you can take it upon yourself to go along and make your own risk assessment. 

If you do decide to go along and make your own risk assessment, be sure to take your work ID so that you can prove the reason behind your visit. The place that you visit will be used to people coming and taking a look to see if it is suitable and thus will let you in for free so that you can have a good look. 

When looking for your risk assessment be sure to look out for sharp edges from which children could injure themselves and also look for potential dangers e.g. water that they could fall in / things that they could climb up and propel themselves off from! Don’t forget to also have a look at the toilets – make sure that there are enough toilets and that they are clean enough ( it may be a good idea to flush a toilet to check and turn on a tap to check for a good supply of water ) Check that there is toilet paper available ( as if not, you can make sure that you bring more with you ! ) 

What to take with you 

Your school may have a first aid bag that you can take with you. Do make sure that you check the contents of the bag instead of simply assuming that it will have all the things that you need. Typically you will need plasters / eye drops ( or eye wash )  / paracetamol/ tissues / bandage / cleaning alcohol and cotton wool – don’t forget plastic gloves for the person administering the possible first aid!

Make sure that you have all the phone numbers of people at the school in case of emergencies and that you have credit on your phone so you can make a call if needed. 

Take money with you (just in case ) – this is to ensure that you have money for an emergency taxi to the clinic if suddenly needed or alternatively if you get there and find that they charge a different price to the agreed one and more admission money is needed.

Make sure that you have a class list and are aware of the number of children that you are taking with you. Make sure that you count the children very frequently – it is much easier to lose a child than you realise!

Ideally, each child should have a badge which details which school they are from and the contact numbers so if a child does wander off alone and is found then the school can be contacted. 

When going on a trip you may be surprised to find that the children are typically squashed into a bus with two to a seat. Do make sure that you put the seat belts on the children ( as much as possible ) and rearrange the adults if needs be so that no children are in the front seat. The front seat really is dangerous for children so do be sure to stress this when getting on the bus.

Although you may have assumed that the main purpose of the trip was to educate the children in a new environment, you will be surprised that your Vietnamese colleagues instead seem to focus on the number of photographs that they can take of the trip. 

Although this may seem irrelevant to ex-pats, in Vietnamese culture it is important to have a wonderful set of photographs of the children on the trip. This will be expected by the parents and the school and will be used in newsletters/brochures etc – so rather than becoming irritated with it, it is advised that you simply join in with your broad ex-pat smile and allow the photos to be staged and taken. 

Allocate a lot of time for photo taking whilst on the trip! 

However, it is fine to make sure that there is time for educational aspects as well. Perhaps the easiest way to do this is to suggest that a certain amount of time is taken for the photo taking and then a certain amount of time when it is educational ( although one person can still continue to take the photographs ) 

You will probably finish the trip feeling that it was a photo shoot rather than an educational visit, however, it is important to simply note that this is the way it is in Vietnam and it won’t change overnight!  

Overall, when faced with organising and going on an educational trip, it is important to be flexible – not to have your Western expectations and assumptions leading your emotions. Instead, simply enjoy it as an experience and yet another wonderful Vietnamese story that you will be telling friends and family in the future!

Although in the South of the country, the weather is simply taken for granted – the biggest conversation is when the rainy season will start and end, in the North, it is a totally different scenario. Although in the heat of the summertime, no one looks at the weather forecast, this is not the case for the remainder of the year where the weather is one of the main sources of conversation. 

The four seasons 

Unlike the South of the country where there are only two seasons – dry and wet- in Hanoi, there are the full four seasons., although it is important to note they are rather condensed – with Autumn and Spring being relatively sort, Winter consisting of a few weeks and summer stretching on and on.

Winter in Hanoi starts at the beginning of December or may start as early as mid-November. As with all the seasons, there is a sudden change – without warning – one day you are in Autumn mode – wandering around with just a light cardigan and then the next day you are suddenly n a huge winter jacket.

You will be amazed at the winter wear that adults and children wear – typically jackets that would not be out of place in the depths of Winter in Canada –  thick gloves or mittens, woollen hats and long scarves. 

Once Winter starts it becomes progressively colder each day until you find that in the middle of January, you really are seriously cold. Although the temperature is not that low, due to the humidity it feels really bitter – especially in the morning when you are going to work and in the early evening when you are coming home. 

You know it is cold when on your bike, you look out for buses and try to snuggle in next to them to stay warm! Hanoi bike riders also respond to the cold by riding with one hand only, the other hand firmly tucked into their pocket! 

It is important to note that all apartments and houses in Hanoi do not have heating. This means that although the temperature is not that low ( perhaps getting to 12 degrees Celcius at night ) as there is no heating, it can feel extremely cold. You will need a duvet and probably a blanket as well ( as the duvets are not thick ) and perhaps you will even need to invest in a hot water bottle !! The good thing is that electric hot water bottles are readily available ( from China ) – these are a wonderful invention as you plug them in for a few minutes and the heat lasts for hours! Then if you do wake up in the middle of the night too cold then it is easy to lean over and plug it in for a few minutes and have a lovely hot water bottle once again!

Spring starts mid-February ( Winter is not long ! ) when the temperatures start to pick up and hover around the 22 degree mark during the day but drop to 17 or so at night. The biggest problem with Spring is that it is wet – not the torrential downpours of the monsoon season which come in a sudden outburst and then are gone – but a miserable drizzle or simply wetness in the air – which can last the whole day! 

As a result, March is always referred to in Hanoi as “ mouldy March  “ – the month when you get home from school one day to find your paint has suddenly fallen off the wall and appears to have gone mouldy overnight !!  In many apartments, you will find there is a tumble drier and you may have been wondering why there is such a thing when clothes usually dry almost instantly – well – it is for the month of March – as it is really hard to get things thoroughly dry due to the high level of moisture in the air so your clothes end up with that musty smell! ( do a big wash in January instead! ) 

Clothing wise, during Spring, if walking you only need a cardigan, however, if on the bike the jacket is still needed morning and evening – although in the middle of the day, a cardigan is enough! 

Summer

Just when you think that there will never be another blue sky and wondering when you will not be feeling permanently wet, summer appears! It is an instant thing – one day it is 22 degrees and the next it is 32 degrees! Once the summer comes there is no reverting back into Spring – instead, the temperature only increases day by day until in mid-June it is super hot – both day and night  – with the temperature not dipping belong 30 degrees Celsius day and night. 

In the middle of summer, it is hard to walk far as you will be dripping in sweat before long – so it is a time for lots of ice cream and cold drinks as well as a dip in one of the innumerous swimming pools in Hanoi.

The summer goes on for a long time – way past the typical summer seasons in the West with September and October still being very hot. 

Then as suddenly as the summer started, the Autumn comes – many say that this is the best time of the year in Hanoi as it is pleasantly warm ( about 28 degrees Celsius) but not too hot. The temperature is pretty consistent both day and night – so you can run or cycle etc without dripping in sweat so there are a lot of people out walking this time of year. 

Overall, the weather in Hanoi is often a shock for newcomers – who assume that the whole of Vietnam is simply one long summer and are often unprepared for the Winter and have to scour around for thicker clothing at the last minute!  – so be prepared!

When you first start off you will think that there are no rules and that everyone simply does whatever they want, however, although chaotic, there are in fact a large number of traffic regulations that people adhere to – and although these are not to be found in any traffic manual, they exist and are found throughout the country. 

Traffic lights

The Vietnamese traffic light rule is that if it has been a long wait, then it is fine to leave before the light is on green. Many of the traffic lights in Vietnam have a counting-down system (as in many places in Europe) – so you are able to see how many more seconds you need to wait before the lights change. 

As a result, rather than waiting until 3 or 2 seconds to get yourself ready (as in the West) in Vietnam, you are ready at about 8 seconds and then by about 4 seconds, people are off as if the light is green. This is important to note – both if you are waiting in the traffic and suddenly get beeped badly whilst still waiting for the lights to change and if you are travelling in the other direction – so your traffic light may still be on green (or just turning ) and you think it is fine to go – however never simply look at the green traffic light and go without looking carefully !

Queuing

There is often heavy traffic in Vietnam – especially in the cities during rush hours. As a result, there is often a need to move slowly along in a queue formation as you move forward a little and then stop and then forwards again etc. 

In the West, this is typically a very regulated process, with the vehicle in front always remaining the vehicle in front, without anyone cutting in. The traffic rules in Vietnam are totally different – although in theory in heavy traffic cars stay towards the centre of the road and the motorbikes are at the side of the cars, in reality, many cars get fed up being in the car “lane “ and instead move over to where the motorbikes are and try and squash along that lane. Inevitably they get stuck in the small space and thus end up totally blocking the whole road, with the motorbikes piling up in a massive queue behind. 

To overcome this, the motorbike rule is to try to get around the car that is blocking the road – so this may involve turning into the other lane, travelling on the other side of the road and then doubling back in front of a car to get back into the motorbike lane.

When queuing, it is important to note that if you leave even the tiniest of spaces at the side/front of you then someone will jump into that space and force you to squash and move backwards. There is no point in getting upset about this as this is just what happens in Vietnam – it is not a sign of rudeness or lack of consideration about your needs. To avoid this as much as possible (since most Westerners find it irritating) it is best to position yourself in the middle of the small space if queuing so that there is limited space around you on both sides.

Overtaking

It is vital to note that overtaking can occur on either side of you – not just on the left hand outside lane. This can take quite a lot of getting used to with it coming as a shock when someone suddenly zooms past you on the inside. This means that you really do need to use your mirrors a lot to make sure that you are always aware of who is behind you and where they are located. 

If you are a slow rider (or simply unsure ) then it is best to try to stay on the right hand side as much as possible ( close to the curb ) so that people can overtake you easily – however do be aware that even if you think that there is hardly any space to the right side and you are tight to the curb, someone may still zoom past!  

Pot holes 

Once you get onto the road you will quickly discover that the road is incredibly uneven – with there being numerous potholes and huge lumps and bumps where roads have been patched up as well as where drains have been put in.

As a result, most Vietnamese drivers drive around these- which means that you may be driving along in a straight line and then find that the person next to you or behind suddenly appears to dramatically serve as they are avoiding the uneven road. This in turn means that you need to swerve to avoid them which has a knock on effect with other drivers. It is always vitally important to be aware of the traffic around you so that if you do need to suddenly swerve then you know which direction to go! Do not assume that just because everyone seems to be going in straight lines that they will continue to do so.

Roundabouts 

The rules in the West for the use of roundabouts are very precise – outlining how to approach and signal when entering the roundabout as well as rules for the lane and signalling whilst on the roundabout and leaving – in comparison, the Vietnamese roundabout rules are reduced to how to get across without hitting something. 

It does not matter which lane you enter the roundabout and which lane you leave – or even the need to signal. However, it is recommended that you do signal  although don’t expect the majority of other people to do the same. Unlike roundabouts in the West where you wait and then go around with the rule being that you never stop on a roundabout, in Vietnam it is fine to stop on the roundabout – simply try to get across as best you can and if you find that you have to stop for traffic then that is fine. 

One very important thing to note when at a roundabout on a motorbike is the fact that not everyone will go around the roundabout the right way – although the majority of people will, if people are only going to the next lane or so, then rather than going round and turning back, they will go round the wrong way!

Buses 

When on your motorbike, the thing you need to watch out for most is buses. Buses do not look or typically signal, and they don’t slow down when swerving to the curb to pick up passengers. Instead, you will often find that you are on the right side of a bus and suddenly it darts straight across the road in front of you, causing you to screech to a halt – with you then having to wait for the bus passengers as the bus has trapped you in front. 

As a result, make sure that when you see a bus you are very aware of it and try to avoid being at the side of it – as it requires quick reflexes to react so quickly and avoid getting squashed! The good thing about buses is that they have a different sounding horn to car and motorbike – so you are able to hear them from quite a distance and know that they are around!

Overall, motorbike traffic may seem completely chaotic when you first view it through Western eyes – however, there is an order and a system – you simply need to accept that it is a different system to the one you know about and be willing and eager to accept and adapt to these new rules!
